On approval of the Regulations on the procedure for transfer (conversion) of land plots
A regulation on the procedure for the transfer (transformation) of land plots has been approved. This regulation is aimed at establishing a unified procedure for transferring (transforming) land plots from one category to another or from one type of land use to another.
The resolution comes into force ten days after its official publication.
On some issues of coal transportation
A temporary six-month ban has been introduced on the export of coal (classified under codes 2701 and 2702 of the EAEU Commodity Nomenclature of Foreign Economic Activity) from the Kyrgyz Republic beyond the customs territory of the Eurasian Economic Union by road transport. This restriction does not apply to the road checkpoints “Irkeshtam – Highway” and “Torugart – Highway.”
Additionally, the restriction does not apply to the state enterprise “Kyrgyzkomur” under the Ministry of Energy of the Kyrgyz Republic.
The resolution comes into force 15 days after its official publication.
On the Approval of the Regulation on Corporate Accumulative Pension Funds
To promote the development of corporate accumulative pension funds in the Kyrgyz Republic, a Regulation on Corporate Accumulative Pension Funds has been adopted. This Regulation establishes the legal framework for their creation, organization, operation, and management.
According to the Regulation, a corporate accumulative pension fund is established on a voluntary basis to provide additional non-state pension coverage for employees under corporate pension agreements concluded between the employer and the fund or a management company engaged in fiduciary management.
The resolution comes into force 15 days after its official publication.
On introducing liability for violations of insurance legislation
Amendments have been made to the Code of Offenses of the Kyrgyz Republic, introducing liability for violations of legislation on employer’s civil liability insurance and non-compliance with safety requirements in the operation of hazardous industrial facilities.
For such offenses, a fine of 3,000 KGS is imposed on individuals and 13,000 KGS on legal entities.
The law comes into force 15 days after its official publication.
On Establishing the Status of “Digital Nomad”
Amendments were made to the laws of the Kyrgyz Republic “On External Migration” and “On External Labor Migration”. The law defines the status of “Digital Nomad” and also establishes that the category of foreign citizens who have the opportunity to obtain the status of “Digital Nomad”, the rights and obligations of the status holder, the procedure for granting the status, as well as the procedure for the stay in the territory of the Kyrgyz Republic of the status holder “Digital Nomad” and his close relatives (spouse, minor children, other persons dependent and cared for by him) shall be determined by a decision of the Cabinet of Ministers of the Kyrgyz Republic.
The Law comes into force after ten days from the date of its official publication.
On the Establishment of the interest Rate of the National Bank of the Kyrgyz Republic
By the Resolution of the Board of the National Bank of the Kyrgyz Republic dated November 25, 2024, No. 2024-П-07/62-2-(ДКП), the interest rate of the National Bank of the Kyrgyz Republic has been set at 9% per annum.
The resolution comes into force on November 26, 2024.
On the Introduction of a Ban on the Import, Distribution and Use of Electronic Cigarettes
A ban has been introduced on the import, circulation, and use of electronic cigarettes in the territory of the Kyrgyz Republic.
The Code of Offenses of the Kyrgyz Republic has been amended to include liability for violating the ban on the use and sale of electronic cigarettes. According to the new rules, individuals will face a fine of 100 calculation indicators for using electronic cigarettes, and legal entities will face a fine of 600 calculation indicators. For selling electronic cigarettes, the fine will be 200 calculation indicators for individuals and 650 calculation indicators for legal entities. Criminal liability is also established for the illegal import of electronic cigarettes in significant and large quantities.
The law will come into force on July 1, 2025.
On the Prohibition of Registration and Issuance of Air Operator Certificates to Airlines
A moratorium has been introduced on the registration and issuance of operator certificates to new airlines until a corresponding decision is made by the President of the Kyrgyz Republic.
The State Agency for Civil Aviation under the Cabinet of Ministers of the Kyrgyz Republic has been tasked with checking the activities of airlines that operate flights exclusively outside the country, as well as those operating aircraft (planes or helicopters) that have not been based at airports in the Kyrgyz Republic for more than one month. Depending on the results of the inspection, a decision will be made to cancel the registration and operator certificates of airlines that do not meet the established requirements.
The decree will take effect ten days after its official publication.
